• About the Programme :
“Labour Law” or “Employment Law” is the body of rulings pertaining to working people and their organizations, enforced by the government and primarily concerns the rights and responsibilities of employees/workmen. Labour law mediates the relationship between workers, employing entities, trade unions and the government. While every worker, employee or businessman should be well-versed in Labour, two reforms in Labour Law in a fast changing India have been in the news in the last couple of years. This programme will focus on recent reforms in the Contract Labour Act, 1970 and Sexual Harassment Act,2013.
• Contract Labour Act, 1970 :
(More particularly recent changes introduce in Budget session called “Fix Term Contract”) The Contract Labour Act, 1970, deals with workers working in industries through contractors in various operations of the plant. The act is also known as Contract Labour Regulation Act, which deals with hiring through contractors and the regulation of their services condition.
The recent Labour violence at Maruti Manesar Plant resulted into human and monetary loss because of contract labourers and regular workers agitation and unrest. The Finance Minister Mr. Arun Jaitley in his 2018 budget extended the concept of fixed term contract for a workman that was applicable to the textile Industry to the general Industry. A Gazette notification now amends the model standing.
Orders to provide for fixed term contract also as an additional categorization of workman called fixed term workers. At the end of the term, the contract is determined and it is actually and unfixed contract that provide flexibility to the Industry to terminate the employment of the worker merely on expiry of the period of the contract and not the expiry of the work.
• Sexual Harassment Act, 2013 :
Rising awareness and action on the protection of women against gender discrimination and sexual harassment as the workplace has led to workplaces being more vigilant and particular handling sexual harassment cases. Every employer and employee should know about The Sexual Harassment of women at the work place (Prevention, Prohibition and Redressal act, 2013) and its implementation and implications.
The Vishakha guidelines, where Supreme Court has expressed that proper law should be framed to avoid and address the issue of sexual harassment of women at the work place. In an urban setup all offices/establishment has a majority of women working in different capacities. It is the organization’s duty to protect all the rights of working women in an organization. The Changes in this Act makes it mandatory for an organization to comply with certain basic conditions of women working in an organization.
